Its good to see some of the Very active members of s-1932 again in this site.
This site looks very good, I followed the S1932 thread in immigration.com very closely, but was disappointed after its defeat inspite all the guys aggressive enthu and hardwork. As most people i too feel that we failed because of lack of Lobbying. If everyone can contribute for noble cause that will be great. I have a small suggestion I am not sure whether it sounds right to everyone or not, but in order to start collecting the funds i would suggest that Moderator open a new thread/link about the contributions so that members who are joining eveyday in this forum will get the momentum to contribute. It would be good if it has name(Registered name), amount and date and the sum collected so far. This is just my suggestion if it sounds illogic please disregard.

Dude, then why are we blaming people like punjabi.........it is not his fault that the supply was abundant and demand receded..........I would still blame the banking system for the housing failure.......they landed out money which they knew would stop coming back at one point in time........and again, it's not that he cannot afford his monthly payments...........he just cannot sell his asset - to me that is a problem on the part of the lender and not the borrower. No wonder banks are re-adjusting the home loan amounts (to a much lower value than originally specified in the agreement) for people who cannot pay the normal mortgage (due to whatever reasons). Go and teach the same lesson to these greedy banks and lending institutions.
Again, I am not saying that foreclsosing (escapism) is a good route to take, as there are other ways to keep the paying the mortgage without hurting your mobility but at the same time it is not prudent to blame it entirely on the borrower - lending institutions are responsible for major part of this mess.

With regard to quality of professionals overall I don't see a marked difference between American and non-American workers. Moreover, I don't think that employers will employ substandard labor just because they are marginally cheap, because it turns out to be more expensive. In all the cases that H1-B and L1 pocket less money than their counterparts the booty goes to middlemen(both Indian and American bodyshps) and not the companies that ultimately use their skills.
You are wrong here. Do you know that companies like TCS/INFY/Wipro offer �blended rates� in the range of $20+/hr for keeping over 70% of staff offshore? Client directly benefits here. I have seen hypocritical companies that took tax benefits from local governments like cities and counties (which came at the expense of property taxes paid by residents of those localities) for job creation and then turned around and outsourced the very same jobs that they were supposed to create to TCS/Wipro/INFY etc., often dismissing the existing contractor pool/employees which involved people of all nationalities including H1-b workers like �TN Man� who couldn�t compete with the $30+ rates for the on-shore workers even if something was available from these vendors. Now to dump people at $30/hr rate, even though talent is locally available - like "TN Man", these vendors will abuse H1 and L1 by securing as many of these visas as they can( which were intended to bring the best and the brightest for american companies), causing Bill Gates to advocate for unlimited H1-bs when in reality, what he needs is a few thousand H1-bs which should be available in normal circumstances, had these companies not been poaching those visas.
So these offshore companies circumvented the prevailing wages through an industrial practice that should be considered �dumping�, where they dumped green-horns for the greedy clients, because the green-horns don�t have to go through any interviews in exchange of the very low rates. In this case, the people dismissed from the company/contractors were a lot more skilled, yet managers like me would be forced to start from scratch with the new pool, often resulting in delays for strategic initiatives at these companies, but the bean counters at the top never care, since their horizon is the next quarterly earning release, not what the company would do 2 years down the line (and some of these companies are the culprits behind financial crisis today with their very myopic thinking, just a sample was illustrated above)
The only jobs that were created in those localities due to such corporations in exchange for tax credits often were Indian Grocery shops opening in that locality to cater to those folks from offshore vendors. :D BTW, I don't have anything against them, I like Indian food.
I have worked with companies where I managed a 50+ member team to execute a project which at another company employing local workforce may have been done with a 12-15 person team (I have managed it both ways and hence I know that as a fact). Now the company employing the 50+ member team will often massage the numbers to show that they saved $x differential per person* 50 for the bean counters and would have secured bonuses for the higher ups because of those paper savings.
Now I think as a result of people like me interacting with US law-makers, they are getting the true picture of the abuse going on with the current processes. I understand many of you here are concerned about your own career and eventually settling in US, but once you become a permanent resident or US Citizen, you are going to face the same realities. I have seen Indian-americans who went through the GC/Citizenship process becoming some of the the fiercest critics of the current system, because (like "TN Man"), their livelihoods also are threatened by the current process. They suddenly understand that it has nothing to do with the so-called "skill" or "talent" shortage, it has everything to do with what your hourly billing rate is.

Go thru these 2 links & familiarize well. Hope your I-140 has approved. Finally these are suggestions only & I am not a lawyer. Consult an immigration lawyer if you have uncanny issues.

2) I just got my Bio appointment and i am all set with that. i received 1 week after the appointment date but we just walked in and got Bio with out any problem.
3) MY EAD is the only problem
As i mentioned it has been almost 2 years and its still pending. i gave my biometrics at that time and i received my AP for me and my husband. My husband (dependent) got ead but not me :confused:

Here is some real advice:
Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

Now let me say this: What is the fault of Punjabi if his house price went down by $200K? He has a load which is not only more than his house value, he is also paying an interest on that loan. It is true that he has got into hot water but how many years will it take to make $200 K? Most of us are not millionaires here. It is true that he will suffer for a few years but I dont see why giving up the house is not an option. Why would he continue to pay interest and principal when his house may not get to the same value in his lifetime? I think foreclosure is a small price to pay in that light.

I will definitely send all these letters today or tomorrow. But why are we not sending to all the service centers? Why only Texas? There are many cases at Vermont, California service centers which were never transferred to Texas. Would it not be appropriate to include these service centers in this campaign?

In I-485, when we enter I-94 information, I am not sure which date to use in the valid field.
The date on my white EAD card expired already. I have a new I-797 which is valid until 2010. My guess is I should enter this date. Can any one please confirm?

My Experience (PIMS):
I was interviewed at Mumbai Consulate on 28th Dec. At the interview I was told that I will receive an email from the consulate within 24-48 hrs at which time I will have to resubmit my passport at any one of the western US VFS centers along with the email and the yellow paper and a photo copy of my I-797.
I gave my passport to one of my friends in Mumbai and continued with the rest of my trip. Till date I have not received any emails from the consulate.
Any body in similar situation and any tips on what should be the next course of action.

You simply can not accept higher skill level based promotion like that. I think you should first sit down with a good lawyer and find out the solution of this already created mess and then think about interfiling.

yes i have i have been following with the TSC via email and there is no update from past 1 month. No reply. I also took an info pass appointment and the officer told the finger prints are old and needs to be taken again.Also my case is assigned to officer and no updates from TSC after that.

What will you do, in EB3 shoes, if the numbers are not moving in 2-3 months. You got it. MOst of them will change to EB2, right. I will too. I am sure you can imagine the scene then. I know 8 of my 15 friends have already jumped to EB2. And I am sure they have much higher priority date than most of EB2s there. So you know what to expect. Lets ALL support for the common cause.

I understand the frustration. Until two months back my PD was retro. Now, I already have my GC on my EB2-NIW I-140 and also had an approved EB1-OR I-140 recently. I am not here to suggest anyone shouldn't do what they think is best for them.
My own understanding of the law is that EB1 gets the left over EB5, EB2 gets the unused numbers from EB1 and the EB5 that went into EB1 but unused. EB3 gets the unused numbers from EB2 and those from EB1+EB5 unused by EB2. This maintains the preference categories (USCIS's definition, I am not saying EB2 is better than EB3).
No matter how the numbers are distributed, there is more demand than supply. It is unlikely all the unused EB1 and EB2 ROW numbers would fall to EB3 ROW and then to EB3-C/I. Some would surely go to EB2-C/I. Right now everyone is retro except EB1 and EB2 ROW. So, redistribution doesn't fix the problem just redistributes the retrogression.
If we can get the recapture and elimination of country ceiling then everybody benefits. The fact that we have an immigration bill is in itself quite something.
No matter how USCIS or DOS allocates the numbers, there will be backlog and its in everyone's interest whether C/I or ROW to think about pushing for the immigration reform bills.
