    I checked my status and it's been showing this for last 1 year..not sure what it means? Does it mean it has been pre-adjudicated? Please let me know if this is standard response once you submit RFE response. Thanks

    I am not sure what AILA is up to. One Mr. Oppenheim already told them that they can start moving EB2I dates in May because there may be unused EB1s. If I am right, that is all he is told them. AILA is just looking to make the best of the statement. What are the ways O's statements can be interpreted to make a profit out of it. There is no reason for AILA to reiterate the statement now. AFter AILS is already told everyone what O told them.

    AILA is now just attached a note to say that if you push PD too much, then you will get too much I-485s than you can handle. Looks almost like AILA is trying to advise the Visa Office. Well that is what lobbyists do.

    This is a good bill. The 50% rule will impact Indian bodyshoppers and Top Indian outsourcing companies. But genuine companies like Microsoft,Google, Oracle and other US companies will not be impacted that much as they sincerely search whether US talent is available. But will it pass? In 2007 it did not move as they planned to consider for CIR. This time also same argument may come. But some genuine Indian consulting companies also will be impacted. But system will adjust quickly even if this bill passes.

    B1/B2 is always prone to reject by 221(b). Wont impact that much.

    I am in a similar situation. I applied just 95 days before. My lawyer "forgot" and I applied in a rush in the end. I am hoping it will not be a problem.
    My understanding is that you will remain in status even if you do not have EAD or AP. However you cannot work.
    I have a meeting with my lawyer on wednesday. I will be asking her about this. I am hoping for peace of mind that this does not become an issue.
    I checked with somebody in the forum like you and he got it in 2 and 1/2 months. I checked in the USCIS web site. It says you have to apply 6 months in advance. I did not know about this since I got it in a month last year when my case was in CSC.

    I have quick question about I-485 filing date. What will be the filing date, the day I mail the packet or the day they receive or the day they acknowledge the receipt.

    I am asking this because I cannot file my I-485 before August 15th due to some personal reasons. So suppose I prepare everything beforehand and mail it on August 16th - will that be appropriate filing (assuming the dates remain current in August)?
    Thanks. Any feedback will be much appreciated.

    Yes, it is for a job which does NOT require security clearance.

    Is there a formal way / method to let the company and USCIS know of such discrimination ? Any published guidelines from USCIS ?

    Your response would depend on how badly you want this job.

    Most times the hiring staff doesn't know the law and are too lazy. Anything out of the ordinary, they just reject.

    If you want the job, you don't want to appear like a trouble maker. So, you could just write back politely that you were surprised by the disqualification since the Department of Homeland Security (do not write USCIS) had issued the EAD and enquire if they know that DHS guides employers against discrimination towards EAD holders. You can mention or attach form I-9.

    Alternatively if you want to hold their feet to the fire, you can contact a lawyer. Hiring a lawyer should get their attention. Let the lawyer contact them. And also let DHS know about this employer. Write to them.

    In any case, we cannot let employers come up with their own laws after we have gone through so much to get to the EAD stage. The law is the law and we are following it.

    Can we remove the clause- 'Allow filing of Adjustment of Status (Form I-485) when a visa number is not available' from the letter. I think this statement is not as per Immigration and Nationality Act (INA).

    Massive IV campaign for Administrative fixes


    Dear Members,

    Immigration Voice is starting a massive campaign to get administrative relief for our community. We have had several fruitful meeting with the administration in 2007, some of these meetings were scheduled in September, November and then in December. In these meetings, we were able to convince the administration about the implication and hardship due to current broken system. Since Congress has not been able to address our issues in 2006-07, we were successful in creating a case for administrative fixes that would give much needed interim relief to EB community. These meetings helped us start a conversation on possible administrative fixes like 3 year EAD-AP, clearly defining �same or similar� if AC-21 is invoked, and we are hearing favorable feedback.

    Due to lack of action on legislative front our community�s patience is running out and we want some relief urgently to get out of probationary status. We are thus starting this nationwide campaign that will help our advocacy efforts and get administration to act quickly. There are several components to this campaign.

    1) Support from lawmaker offices: We urge all our members to meet their lawmaker offices and get them to write to The President in support of administrative fixes and urging for an immediate administrative relief. The template of the letter is attached. Letters from lawmaker offices to administration get far more attention as compared to anybody else writing the same letter. The template of the letter is posted below. Please request lawmakers to give you a copy of the letter or lawmakers could copy IV on their letter to The President.

    2) Support from employers: We urge all members to approach their employer and have them send a letter to The President expressing support for our administrative fixes and appealing for an immediate relief. The template of the letter is attached below. Please request your employer to give you copy iof the letter so that you could provide IV with the copy of the letter.

    3) Plea from our community: We urge all our members to write personalized letters to The President directly and convey their plight. If you would like to write your own personalized letter, please do so with your own story. Make sure to stick to the administrative fixes we have listed in the letter template and how these fixes could help you and your family. Please put your name and address in your letter. Anonymous letters will not be delivered and will be discarded. We request that you create 2 copies of your letter. One copy should be posted to The President and the second copy should be sent to Immigration Voice mailbox address at �

    The deadline for receiving all the letters is 9th February 2008. We will also try to get media coverage for this campaign and draw national attention.

    I bought a house in the year 2006 (2 years back as Punjabi did)....there were reports, news items, articles everywhere talking about the real estate bubble with data available by cities/states. So saying something like "what is the fault of Punjabi" is not fair as we are all here because of our "extraordinarily high skills". And where did the $200 K number come from ? In the city where I live, the average house price was $220,000, I bought a house which was worth $185,000. I knew my limits.

    First of all I am not affected by foreclosure and nor do I own a property.

    Now let me say this: What is the fault of Punjabi if his house price went down by $200K? He has a load which is not only more than his house value, he is also paying an interest on that loan. It is true that he has got into hot water but how many years will it take to make $200 K? Most of us are not millionaires here. It is true that he will suffer for a few years but I dont see why giving up the house is not an option. Why would he continue to pay interest and principal when his house may not get to the same value in his lifetime? I think foreclosure is a small price to pay in that light.

    and for my husband it says

    Your Case Status: Decision

    On September 24, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

    I dont understand why his case is in decision when he is the primary .. Has anyone come across similar situation ?
    My PD is sep 05 and service center is TSC.

    As it has been 85 days since my 485 reached in NSC and updates, so I called the 800-375-3283 and transfered to IO, she was very polite and told that now they are taking 120 days to issue receipts. ( ware...waa...how fast service)

    As CAA dude post a 800-246-8253 this is Custom #. (lol)

    So they started to say now all we have to wait for another 30 days, there is no other way to get the receipt #, she said call once in a week if u are lucky, u may get ur receipt #,

    yes sending fax, e-mails, create a query this make sence to invistigate the pending application.

    Ok again ur count down starts against 120 days..........

    Whatever way it is USCIS has again lived upto its July fiasco, return I 485 applications without accepting and now send the flowers away to hospitals without accepting....end of the day...no evidence left behind..

    Seems popular logic with USCIS....

    There are plenty of folks waiting approval like you including me as well... If your attorney has followed up with USCIS and if u have created an SR, thats probably the best you could do to let USCIS know that they shudn't b sitting on ur case...

    l1fraud. L1s cannot be hosted at client site when the client site manager has supervision on him/her.

    ICE has a historically poor track record on enforcing H1b/L1 rules. Only lately there has been on enforcement on the H1B rules. All that one can do is complain to USCIS / ICE
    etc but they don't do anything then you may have to talk to you senator/congressman etc. Sometimes senator/congressman are also non cooperative.

    Let alone L1, even B1 visa is used like a short term work permit by many IT companies including American IT companies

    I cannot believe you are saying this. Are you actually saying that you will let stuff like this happen just because you think your company might get rid of you if you complain? If your wife or daughter has a boss who is flashing her everyday, will you actually tell your wife or daughter to 'suck it up' and put up with it just because you fear she may not get a reference??

    Laws are designed to prevent this exact kind of thing. I personally would, to quote a Hindi movie dialog, take a sledge-hammer and change the geography of the abuser's face. On a more practical note, I would lawyer up, collect evidence, spin up a multi-million dollar lawsuit, and use settlement money to sip MaiTai on some beach in Lanai, while the harasser gets to suck on cock-meat sandwiches in the nearest penitentiary.

    Sense of guilt... the guy who is breaking the law should have that. Not the victim who wants a reference. C'mon grow a penis!


    Well, I am just stating facts. Just because you dont like them, I cant help it. You got to learn to move on. There is a saying in my native tongue " A smart man should never climb the stairs of a court." My grandfather was a prosecutor and and used to tell this to me many times. But thats just me.     I have received Courtesy copy of I485 Approval notice, and law firm received the Original I485 Approval Notice.

    Is there any use for Original I485 Approval Notice or just Green Card is Enough?

    It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Since it was my very first trip to US , I meekly showed her my papers.After that she had issued the boarding pass.

    Friends, you may think I am very meek.This was not my first overseas trip. I had visited Japan previously. I didn't want to have fight with her and start my journey in bitter taste from the beginning.

    Don't think only Non-Indians treat Indians shabbily. Our enemy is within.

    If I happened to see that lady once again in Chennai -------

    the airlines want to make sure that you have h1b stamp on ur passport. They always do.

    Emirates is good. No TV hassels. JFK to HYD trip is good because it starts at 11pm but on the way back it was little painful because you start your journey at 4 am in the morning and if you are a person like me who can't sleep at irregular hours, then it can become painful sitting for long time in the flight.



    We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I stay pretty closer to Harrisburg, PA ...thanks
