    Most makes sense but I don't think any candidates wait for their companies to file for EB1. EB1s can be filed by the candidates themselves. Right? All in all, if this happens, it will be good news for atleast a couple of 1000 EB2-I. :D

    EB1A/EB1B does not need but EB1C needs employer and was exploited by the Indian companies to the max. possible extend for the so called global managers

    I am not sure about his public position about legal immigration but I think he made it difficult for immigrants (Legal and Illegal) to get driving permits in CA.


    I have a CA driver license. Its not tough for legals. He only made it tough on illegals

    Remember: NumbersUSA faxed the senate offices one million times when CIR was being considered. We have to do more than them this time, as they are twisting the facts (Same way Mr. Dobbs of CNN does): Here is a quote from Numbers USA website:

    The last line above is a blatant lie. Specially when USCIS ombudsman who has access to all the internal material of USCIS says otherwise. Please call, and let the congressmen and congresswomen know about this.

    If this information is correct then we are in much better shape then was being projected. what is scaring me is the number of applications that are pre 2004 the number seems to be pretty big? are these abandoned applications. Also does any one know this report is current as of when?

    I understand you started the above "reference name check thread". Is there any reason that one has to talk about name check related issues only on that thread? This is a lean period, there are no emergencies or deadlines, the lists are not clogged with any urgent matters. Last week I requested info about name check, and got a similar posting from you. Now someone has put up a set of useful documents and a few others are discussing it, and again you are making the same posting about your thread. Is there an award for "most read thread" that goes to the thread-starters? By discussing an issue that interests you in a different context, is there any reason for you to become overtly concerned for where the discussion should be placed? Why cant you get some web admin privilege from the core and gather all "name check" postings under your darling thread cited above? Maybe your intentions are good - a mega reference for name check-, may be you want to create a resource on the lines of "namechecks r us (or) s me", but give us a break.
    This posting is written more on as an observation, not as a criticism, commentary, or finger pointing. So during your "website-policing-for-namecheck-postings" process, if you come across this, please dont become too defensive to reply to me. Even if you do, I would not respond.

    I think you can go ahead to the HR and just ask for a letter stating that your position xxxx is still available for you and that you are paid xxxx. If not, you may receive a RFE for the letter. I have seen some people not getting a RFE for letters if they attached most recent pay stubs showing they are paid prevailing wage.

I have also just seen a caution on Matthew Oh's site where he indicates that USCIS may not issue RFE's but issue outright denials if the "initial evidence" is missing.     for once sepia mutiny decided to cover our story. i still dont understand that blog. more than 80% of the posts are dedicated to ridiculing indian issues...most of the contributors are indian americans...but they never cover our issues.

    i cant understand why they cant make up their mind...either limit yourself to covering indian american issues or accept that we are a part of your ethnic group too. is there an african american blog that keeps harping about child mortality in africa? is there a italian american blog that is dedicated to researching origins of pasta recipes in italy?

    i dont get them but at least we get some more coverage.

    All,

    Its good to see some of the Very active members of s-1932 again in this site.
    This site looks very good, I followed the S1932 thread in immigration.com very closely, but was disappointed after its defeat inspite all the guys aggressive enthu and hardwork. As most people i too feel that we failed because of lack of Lobbying. If everyone can contribute for noble cause that will be great. I have a small suggestion I am not sure whether it sounds right to everyone or not, but in order to start collecting the funds i would suggest that Moderator open a new thread/link about the contributions so that members who are joining eveyday in this forum will get the momentum to contribute. It would be good if it has name(Registered name), amount and date and the sum collected so far. This is just my suggestion if it sounds illogic please disregard.

    Your suggestions are welcome. We have also received requests wherein people don't want their contributions disclosed. Anyway since this is a voluntary donation, we will post some kind of overall numbers in terms of collections versus target which should help.

    I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.

    Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.

    The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants. I am afraid that Senator Durbin will make the calls when Senator Obama becomes the president.

    Please post your opinions. This is a very important discussion. It is very important that the community see what is in store for us when the new Administration takes charge.

    A lot of folks in the EB community are looking forward to 2009 thinking something will definitely happen. Yes, something will definitely happen - and that may not help us

    I think the company should be filing the fees but lawyers fee for filing is not their liability. Hi Folks,

    In many of the articles and forums I have read that applicants spent a lot of money on medical exams, lawyer fees, and so on towards the Employee based Green Card application.

    Is it legal for one to spend money (out of one's own pocket) towards getting employee based green card ?

    From what I had hear from my company's legal department was that they cannot take any money from me towards the green card application as it is not legal. Employee Based Green Card is for Employer's benefit and not employee's....though it eventually helps the employee -:)

    Any comments ?

    I don't understand why some section of educated people doesn't understand small things...
    1. Intention in sending the flowers is to gain attention from USCIS and the media.
    2.Do you know one thing, USCIS director himself helped us more than half to gain media attention by making a statement and forwarding those flowers to the Hospital.
    3. If there are 'n' flower orders, they will reach 'n' families in the states with our message in them. Our initial goal was to gain the attention of USCIS director and media. Now we are getting a bonus of 'n' families and their mouth publicity to our problem.

    If you sent flowers, and you differ in thinking atleast have patience and see the result in couple of days. Don't do any bad at this point.

    Lets hope the best.

    from doing that, what do you think you would achieve by the flowers being delivered at the hospital instead of the USCIS, the point has been made and the Director has acknowledged the effort - That was the end goal and infact the flowers will do more benefit to those in the hospital.

    Call the place where you've ordered flowers and ask for a refund if flowers are delivered elsewhere. It should be up to USCIS to recieve and then ship those flowers to the hospitals.

    Did it suggest lots of denial rate on 140 (especially Eb1s)? And it is deterring 140 filing since Jan.? I believe all those lawyers, and bodyshops realize it.

    Neither the denial nor the approval rates are significantly changed. However, the receipts have fallen. Look at that as many universities and private companies not hiring teaching and research specialists. So it seems like the economy is the deterrent.

    Lost in all this is the fact that Punjabi wants to sell his house not because he cannot afford it anymore, but because he wants to move to a different city to a higher paying job and can't be bothered to take responsibility for his failed real estate venture. He could have done the ethical thing and stayed in his present job and paid off his loan but he is choosing not to. And who does he blame for his situation? The concept of the "American dream". So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If someone cannot learn from one mistake, I say let him keep making mistakes. He will soon find out how difficult life in the US can be if you don't have a good credit history. As for the burden on us taxpayers, hey, we've been spending 10 billion a week for the past 5 years dropping bombs on people, what's a mere 20K?

    Your response would depend on how badly you want this job.

    Most times the hiring staff doesn't know the law and are too lazy. Anything out of the ordinary, they just reject.

    If you want the job, you don't want to appear like a trouble maker. So, you could just write back politely that you were surprised by the disqualification since the Department of Homeland Security (do not write USCIS) had issued the EAD and enquire if they know that DHS guides employers against discrimination towards EAD holders. You can mention or attach form I-9.

    Alternatively if you want to hold their feet to the fire, you can contact a lawyer. Hiring a lawyer should get their attention. Let the lawyer contact them. And also let DHS know about this employer. Write to them.

    In any case, we cannot let employers come up with their own laws after we have gone through so much to get to the EAD stage. The law is the law and we are following it.

    I wish I had all the data on his reporting for H1B visas. He always makes it sound like there is unlimited H1B visa available for foreign workers and nothing can be further from the truth.

    I hate to watch his show anymore but I'll from now on just to report the lies and inconsistencies he reports in his program. Let's do a "Expose Lou" campaign. I would love to spend any free time I have on this noble cause.
