OK I will help in the research.. but this is what I have seen.. all the lawyers are just advising or strongly advising.. no one has metioned why one should NOT do multiple applications, the only reason I have heard so far is that multiple applications (4 - if both the spouses apply for each other as dependents) may cause confusion in allocating the A# and that may lead to problems and complications and eventual delays....
but both me and my wife already have A#'s so does that mean that there wont be any confusion as uscis need not allot A#'s for us.....
jeez.. man ... some one should know better......
anyways I will do more research and pm you if I find any more information apart from what I have stated above.

Fill it with both primary and derivative details. Write in small font with a pen. This will avoid different forms for each applicant.
If you take 1st line you want to write two names in it, that would create a confusion.
If I fill up another applicaiton for derivative, I have to fill up the same way as I filled for myself right? then I will go for this option.

Wish there was a way to nudge USCIS on quicker approvals- most people know that there is case is pre-adjudicated,with IO and current. Now, if IO is taking a look at EB-4 applications then who knows..when our apps will get picked up

Do you what you are talking about? One more term for GOP is a disaster. McCain would do nothing but spending more money on Iraq. There is no policy for John McCain. His only aim to continue Iraq war for 4 more years, and if possible, another four more years. They DON'T support same sex marriages. Remember! they are conservatives for God's sake. Republican party is good for oil companies and big corporates. For normal people like us, and specially for an immigration community, it would be an irreversible damage.

Spouse : PD Feb 2006 - EB3.
Suggested by our lawyers.
File my I-485 with spouse as dependent,
File my spouse's I-485 with me as dependent mentioning receipt notice of first I-485.
File for only one set of EAD and AP docs. Doesn't matter with which.
Filing both in July '07.
The pitfall to that is with the current rush it could be months before you get the receipt and by that time the spouse's date could have retrogressed.

Thanks. I did sent email and fax last week.
What action do we expect on our letters/faxes to Congressmen, besides a routine reply USCIS is used to. This is not the first time that somebody is bothering them in their leizurely work. If they have tons of filings all over their offices, how do you expect them to find your case out of them.
USCIS continue to say that they have loads and loads of filings yet to be entered.

Let us all send AC21 action item mails to USCIS. Let us send some more through our spouses and teenage children. Also get some more signed by our friends and neighbors.
The letters are very generic. They can be sent by anyone including GC holders and citizens too. All it costs is a few Dollars! So what are you waiting for you? If you have hired a nanny, make her send one too :)

For more information, we went to visit our home country and re-entered from JFK with no issue twice after 2004. We got H4 tranfered, EAD advanced Payrole too with no issue al all. Looks like "nunc pro tunc" is the solution according to Murthy. Anybody has experience with "nunc pro tunc" please post your experience. http://www.murthy.com/news/n_nunpro.html

01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that
02. Submit current dated EVL for your new employer. No issue. we can answer that
For my wife also asking for 2 evidences:
01. About the same medical issue.
02. Provide her non-immigrant status between Feb 2003 to Jan 2004.
I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.

I have also spoken with the Immigration Officer in the local USCIS office (InfoPass appointment) on July 27th, 2007. I have learned during that interview that my case is pending due to the FBI Name Check. The estimate that has been given to me was as long as 3 to 5 years, maybe more.
So as of now my application is pending together with 320,000 others. Well since it's been pending for almost a year now I'm a proud member of 152,000 who had been waiting for more than six months, slowly moving to join more than 61,000 lucky ones that had been waiting for more than two years. Hence my next question.
4. Did anyone hear the Name Check clearing between one year and two? Based on all of the people I've talked to it either took just a few months or more then 2 years. Seems to me once they put your file in that special pile it will not take less than 2 years.

I just talked to one of teleblend rep (live chat on their website, very easy to do and I can do this during lunch time from office). The guy said they are working on something but was not providing any time line or details. I told him to hurryup else I will switch. Looks like we need more teleblend customers contact them to get this done faster. Guess they are waiting to see what effect or how many customers actually switch to vonage. Teleblend must offer $20 world plan in order to stay afloat in competition. I say this as they now offers $15 unlimited us-canada Vs. vonage $25 unlimited us-canada plan so far.
I'm also using teleblend and will call them tomorrow to ask for the deal...Currently their unlimited india plan is $35 + $15 + tax = close to $55.

This issue will hit everyone sooner or later especially in rough economic times that we currently have. Even if you do not plan to use AC21, due to current economic down turn..One might be forced to use AC21..
Let us start this campaign. Please DO send letters. As we also have IV support now, let us get a resolution for this issue with the help of IV leader ship..
This will help people who are already affected due to these denials and aviod denials for other people going forward.. Printing and mailing the letter will take only 10-15 mins of your time..This campaign will be a sucess only with support from every one.

I filed a G28 to allow me to represent my wife. I did not use an attorney. If you are filing for more than one person then I think that a G28 is worth it. It is a trivial form.

I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.:confused:
