Something is screwed up.....
Mexico has over 2000 cases in April 2001 yet its PD is May 1st 2001
India has less 500 cases in April 2001 yet its PD is Apr 15 2001
This along with CIS giving "bad/incorrect" data to IV is indication of someone's malicious intentions.
I appreciate IV's effort in getting FOIA executed and now working on aftermath of it.
For people who are angered with whats been going on in last couple of days. All I can say is to try volunteering for IV even for a month.

Don't know if anyone noticed but Mr. Emilio's statement nowhere indicates any acknowledgement of the hardships caused by the fiasco. If he (and USCIS) knows about "flowers", I am sure USCIS knows about the scramble, hardships and frustration caused by the fiasco. A simple acknowledgement through something like " ....while we regret unintended consequences of following our internal procedures, we have made arrangements to forward the flowers to ..." would have demonstrated leadership or honesty of intent which I guess is in short supply

2) I didn't realize this until this evening when I mentioned the whole flower thing to my wife and she reminded me that government officials and agencies aren't meant to accept gifts from anyone. I believe this may have been considered a gift, or at least a grey area and perhaps they believed that discretion was the better part of valor.
I work for a government department, not as a State employee but as a vendor, and they aren�t allowed to accept anything from us that may be construed as a gift. Even when we have our annual golf days, ours are paid for by the vendor company but the State is forced to pay for themselves.

take your i 485 application. There is a received date column and notice date column.
Date received is the date they received your application,notice date is the date they entered your application was entered into their system.
So, if someone with priority date of 08may2006 (eb2), but with a notice date of aug 30 2007 will get the green card earlier than someone with priority date of 20april2006 (eb2) with a notice date of sept 15.

all this is because of the stupid indian government.. they dont have treaties with any other country in the world... that is called visa reciprocation.
All tom, dick and harry to enter india needs a visa and hence all countries dont have that treaty...
the 2 countries tat dont need visas are St.Kitts and Nevis and jamaica....LOL

It is simply crazy of USCIS, but it is not beyond commonsense for us to realize that the notice was mailed in last few hours of the previous FY, so there might have been those hiccups between USCIS and DoS systems releasing the last few visa numbers.
Understand that you might well be current for this FY but the notice was generated in September. So now you should do your best to make sure your file is not relegated under a big heap somewhere... as others so rightly suggest, the congressperson route should serve well.
I recieved 2 notices in mail today.
One is the welcome notices which says that I-485 is approved.
Another notice which says that they reviewing or reconsidering the decision previously taken.
Called 1-800 # and the infopass. They say that reopened or reconsidering the case as the visa numbers retrogressed.
How can that be when am current in oct as well.
Mine is EB2 and the priority date is Dec 2004.
Any suggestions to have this fixed.

Exactly you are right. Right now they are concentrating on EB2 only. Once the EB2 becomes Current all the visas are rollover to EB3.

If you guys really care about 2002-2003-2004 guys, then please please wait for OCT 07 bulletin and after that you can do anything you want. If they will retrogress the dates, then please fight but not before that.
This is just a suggestion. If you like follow it, otherwise ignore.

Hi,
I have an approved I-140 (EB2 PD Jun-06) for a 'software engineering' related position. I recently moved to a 'product marketing' role within my company and was told that we would need to refile my PERM since this move constitutes a material change. Is this true?
1). Will I be able to retain my original PD of Jun-06 if we were to file for a 'marketing position'? Or would this be only possible if I needed to refile for a 'software engineering' or similar role?
2). Is there any way I can benefit from EB2 becoming current in July given that I have an approved engineering I-140 despite the fact that I have moved to marketing? (By the time I refile a new marketing PERM, I suspect retrogression will be back in effect)
3). My H1B was recently extended by 3 years (I complete 6 years in a few days) based on my 'engineering' approved I-140. They also filed an adjustment of my job duties to reflect my marketing role. I will visit Calgary, Canada next week (June) to renew my H1B stamp. Any chance that I might have problems during my interview since my 'engineering' I-140 is really not any more use since I moved to marketing? I'm just concerned that there might be problems since the 3 year extension is approved based on an 'engineering' I-140 and now I am no longer in an engineering role? Am I being paranoid :)

One of my co-workers recently went for 10th year stamping to Mumbai consulate. He was asked to wait for 4 weeks. Looks like renewals and extensions beyond 6th year are taking long time for stamping. He works for fortune 500 companies and with 20,000+ empoyees worldwide.

That's not correct. FBI cannot deny somebody a visa JUST BECAUSE they cannot do their job in a TIMELY FASHION. Law states that "YOU ARE GUILTY ONLY WHEN ITS PROVEN"
Also, Please keep in mind there are over 12 MILLION ILLEGALS WITH NO RECORD!

There are a lot of interpretations. Popular Attorneys like Rajiv Khanna and Sheela Murthy claim it is not valid and always advise clients to have a h1b backup. Not sure why they are so keen on h1b. It could be because some adjudicators may send EAD revocations also along with 485 denials.
Chandu, they may have other good reasons to do so, but one advantage for attorneys is an added fees out of filling for H1B; and for employers is less employee turnover due to the fact that even if employee is willing to change jobs. It is not so easy to find next job with H1 sponsorship than to be able to find one on EAD :)
