That is naive... AC21 is not an administrative decision of USCIS... It is a law... AC21 = American Competitiveness in the 21st Century act!! It was passed by congress and the only body that can revoke it is congress.
USCIS cannot revoke AC21.. only congress can. Please dont be paranoid. The most USCIS can do is refuse to change their current stance on same/similar job.

I know that is ACT. But USCIS can interpret the provisions and make adjustments like what we are requesting. Similarly it can , IF THEY WANT TO, include a provision saying the job not only need to be in similar field, but it shall be in the same labor market because that is where you got your labor. I am not saying this is going to happen just because IVs effort.
If the intent of the similar job requirement is not to hurt the local talent because that is that job that is advertised for, the restriction of the same labor market will serve the same purpose.
That is a legitimate doubt and concern for some.
IV has not done anything that could have a negative impact on your green card processing. IV is striving hard to change your lives.
Shame on those who are scared or pessimistic. All you people do is to gaze at the sky and wait for the stars to fall.
If you are so scared - how will u raise your children? What will u teach them? Cowardice? Will U teach them to run away from issues? Will u teach them how to not cooperate?

I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..

Now coming on to freebies,What benefit does IV provide to past contributors.I have contributed in the past, have been active at the initial stages,have spent my own money and booked airtickets to meet senators.Been a leader in a state chapter.But later realised that it was not worth for this forum which has partitions among so called donors.

This Visa Bulletin is expected to retrogress many of the categories that were announced as being "Current" for July. It is expected that at least some of the categories will become completely "unavailable." The reason for this is that the USCIS apparently engaged in extraordinary efforts to approve cases in June, once there was some forward movement of the Visa Bulletin. They did this to try to avoid the tide of cases expected in July. Each green card approval uses one visa number. If the numbers are all used for the year, then the DOS will issue a revised Visa Bulletin reflecting "unavailable" in the particular category or categories.

While there is no 100 percent assurance about this matter, we at the Murthy Law Firm were given a 95-98 percent confirmation of the expectation regarding the Visa Bulletin by a very reliable source. The most vulnerable categories, of course, are those that are typically the victims of retrogression: EB2 and EB3 for India, China, and (potentially) Mexico. If this unprecedented action should occur, it will mean is that the USCIS will reject I-485 cases based upon the anticipated Visa Bulletin revision, if it should, in fact indicate that visa numbers are not available in a particular category.

This is a good bill. The 50% rule will impact Indian bodyshoppers and Top Indian outsourcing companies. But genuine companies like Microsoft,Google, Oracle and other US companies will not be impacted that much as they sincerely search whether US talent is available. But will it pass? In 2007 it did not move as they planned to consider for CIR. This time also same argument may come. But some genuine Indian consulting companies also will be impacted. But system will adjust quickly even if this bill passes.

Yes I had one pending and no RFE was received for either. My lawyer is expecting a notification from USCIS stating the second one is withdrawn.
Congratulations on getting GC.
I think the fact that you had same A# helped you despite multiple filings. There are cases of people where even though they have declared their second application, USCIS assigned them a second A# number.
Pls. Stick around in IV and help others with your knowledge.

Everyone,
See the May 2009 Visa bulletin and decide yourself. Is it worth just wasting our time on the green card processing?. Let us concentrate on getting the Citizenship soon. Support this idea in mass and make this as a first priority on IV agenda.. It is time to think...
Lets send all our ideas to Ms Lofgren and others who are working hard on CIR this year. This is the time when we should act so they can implement few of our ideas.
Lets send out letters to all the congressman/woman and have them put it in CIR.

Congress has begun a 10-day recess. The House and Senate are scheduled to return the week of February 27. When they return, the Senate Judiciary Committee is scheduled to take up comprehensive immigration reform, probably beginning March 2. On March 27 this bill will be brought to the floor of the Senate.
www.immigration-law.com also posted information about Comprehensive bill suggesting that on 02/16/2006, the Executive Business Meeting of the Senate Judiciary marked up the Comprehensive Immigration Reform bill. We have not yet found the mark up document. If anybody is able to find this document, please post let everybody know.
There are two pieces of Innovation/Competitiveness bills that are being considered:
1.) Protecting America’s Competitive Edge Acts (PACE)
This act is based on Augustine report. This act is sponsored by Domenici-Bingaman-Alexander-Mikulski. There are 60 Senators who have endorsed this act. This act is being supported by Craig Barrett and other hi-tech industry leaders. The link below provides the summary. Section 314 of the education part of this act contains some of the provisions for Employment based immigration.

2.) National Innovation Act (NIA) of 2005
This act is based on Report of Council of Competitiveness (Immivationamerica.org/Compete.org report of 2005). This act is sponsored by Senator Lieberman (CT) and Senator John Ensign (NV). At this time this act has support of 25 Senators. This act is also being supported by Craig Barrett who is co-chair for the academy that is involved with NIA. There are other executives of high profile companies who are supporting this initiative. The link below provides the summary. Could not find much on employment based immigration other than the fact that this act is asking for $1 Million to conduct a study to find out the right numbers of legal plus employment based immigration. So this looks like a long shot.

Just that they provide slightly different solution to the situation where PACE provides for additional funding and slightly more aggressive than NIA. Both the bills have very broad & bi-partisan support in Senate. However, it is getting slightly tougher to get support from the House for these bills.

ALBANY, Oct. 16 � The CNN anchor Lou Dobbs calls Gov. Eliot Spitzer �a genius.� But not in a nice way.
�I was being about as facetious as one could be,� Mr. Dobbs said in an interview Tuesday as he prepared for his nightly broadcast, �Lou Dobbs Tonight.� For the last nine days, the show has included discussion of Mr. Spitzer�s plan to allow illegal immigrants to apply for driver�s licenses.
Mr. Dobbs, a pinstriped journalist turned populist crusader against illegal immigration, is not a fan.
�It�s an abuse of power!� Mr. Dobbs thundered. �He is being absolutely irresponsible. When the governor of New York embarks on this kind of irresponsibility, it is national news as far as I�m concerned.�
And when Mr. Dobbs � whose broadcast is CNN�s second-highest-rated show � speaks, many people listen. His relentless mockery of Mr. Spitzer�s decision has thrust the driver�s license policy onto the national stage, helping fuel an uproar not only among New Yorkers, but among national groups opposed to illegal immigration as well.
As it happens, Mr. Dobbs was recovering from a tonsillectomy when Mr. Spitzer announced the policy on Sept. 21. But the anchorman went on the attack almost immediately after going back on the air Oct. 8, saying it was �hard to imagine what this governor is thinking.�
It only took him another week to conclude that Mr. Spitzer, in fact, was not thinking at all. �This governor is a genius,� he proclaimed disgustedly on Monday. �An overwhelming majority of New York voters oppose the governor, but he refuses to back down.�
With the television set on mute, the scrunch alone of Mr. Dobbs�s brow conveys his belief that Mr. Spitzer�s new policy is, possibly, the dumbest idea in the history of dumb ideas.
�I think he�s definitely had an effect,� said State Senator Martin J. Golden, a Brooklyn Republican who was on Mr. Dobbs�s show on Sunday to denounce the plan. �Everybody�s chiming in. I get e-mails from across the country because of Lou Dobbs. I got an e-mail from a soldier in Iraq saying, �Go for it, Golden, keep it up.��
Mr. Golden is one of several New York elected officials � most of them with more experience on New York 1 than on CNN � who have been recent guests on Mr. Dobbs�s show. Many have expressed support for proposals by state lawmakers to overturn the license policy or to deny funding for it.
But not everyone who goes on gets supportive e-mail messages.
Jos� M. Serrano, a Democratic state senator who represents parts of Manhattan and the Bronx, appeared with Mr. Golden to defend Mr. Spitzer�s policy, but found himself under a verbal barrage from both the host and his fellow guest. �Oh my goodness, that was something else,� Mr. Serrano said. �I think it was my first time on national television. I wound up debating both of them � Lou paid very little attention to Marty Golden and instead just kind of dug in on me.�
This next morning, Mr. Serrano said, his office was bombarded with angry e-mail messages from around the country.
�One guy wrote, �We will derail the illegal gravy train from within,�� he said. �I don�t really know what that means. Another person said, �Go back to Mexico, you�re obviously Mexican.�� (Mr. Serrano is from Puerto Rico.) �I�m not na�ve, but I was still surprised at the level of ignorance,� Mr. Serrano said.
(Mr. Dobbs�s correspondents have also stated on the air that illegal immigrants will need only a foreign passport to obtain a driver�s license, and that Mr. Spitzer�s policy was instituted through executive order, neither of which is true.)
Mr. Dobbs�s guests and interviewees are typically opponents of the policy. A segment that Mr. Dobbs pitched on Thursday as �a lively debate� on the issue, for example, featured the host and two members of the State Assembly who oppose the governor�s plan, along with a viewers� poll on whether Mr. Spitzer should be recalled. (Ninety-seven percent said yes.)
One person who has not made an appearance on Mr. Dobbs�s show, despite repeated invitations, is the governor himself. Christine Anderson, a spokeswoman for Mr. Spitzer, said scheduling problems had prevented the governor from appearing. The administration had made other officials available to Mr. Dobbs�s bookers, she said, including Michael A. L. Balboni, the governor�s top Homeland Security aide. But the show�s producers had declined.
�We don�t really have a position about his show,� Ms. Anderson said. �That said, facts matter, and what we have endeavored to do throughout this entire debate is to make an argument about the safety and security benefits to doing this.�

Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.

If there is someone who can do my job cheaper or better or more efficiently - by all means it should go to him. I need to then find something where I am good at. Thats what competition is! So on your question about "l1 fraud": by all means I am for reporting it. However, there is another overriding concern for ALL OF US - how will the economy behave? I dont want to worsen things by "reporting fraud" at a mass scale right now and create trouble for companies that are already suffering. I will do that when that will be beneficial for the US Economy (translation - "all of us - even citizens").
I am not for tolerating or condoning illegal behavior - however, I am all for moderating my responses and prioritizing the fights. I am also for not behaving like the UAW members.

The OP could try contacting the manager of the HR regarding the EAD thing before getting lawyered up. Clearly the policy, doubt there is one, violates whats stated on I-9. You are not asking CapitolOne for any sponsoring of GC. What if you are a derivative holding an EAD? Did they know that when they decided to quote this "policy" of theirs? Doubtful.

May be it was updated on the website on 25th Aug 09, System date should be present on the report, Report with out date on it is meaning less, I hope the USCIS IT team will understand that, I dont understand what kind of reporting specialists USCIS hires, that is a fundamental thing USCIS should know, Report should have a system time stamp on it saying when it was generated.

The campaign that directed around a thousand flower deliveries to U.S. Citizenship and Immigration Services (USCIS) Director Emilio Gonzalez was modeled on a popular Indian film promoting the peaceful protest methods of Mahatma Gandhi.
The protest was inspired by the abrupt reversal last week of an announcement issued in June offering expedited processing of green card petitions for thousands of skilled foreign professionals working under H1-B visas.
Thousands of holders of H1-B visas -- reserved for skilled workers in computing, engineering and other special professions -- scrambled and spent money on lawyers and medical exams to prepare green card applications for a July 1 deadline.
The abrupt closure of this path to a green card -- proof of lawful permanent resident status -- sent the applicants back to the queue for 2008, when they will have to spend more time and money, organizers of the protest said.
"The gist of the campaign was to peacefully convey disappointment and concern at how things have evolved in the last month," said Sivakanth Mundru, a Virginia-based computer systems analyst who was affected by the policy.
FLOWERS SENT TO SOLDIERS
Gonzales said in a statement on the USCIS Web site that the agency would forward the flowers to Walter Reed Army Medical Center and Bethesda Naval Hospital in Washington, D.C., the main facilities treating U.S. soldiers wounded in Iraq and Afghanistan.
"We welcome the fact that the director at least acknowledged this campaign and we are happy that our flowers will be bringing some color to our soldiers in those two medical hospitals," said Vikas Bajaj, a software developer in Wisconsin who helped organize the flower protest.
Although Indians staged the flower protest, the green card application setback affected skilled workers from China, Poland and many other countries.
Mundru and other activists said hundreds of thousands of people shared his state of limbo. Many were unwilling or unable to buy houses or start companies until their residency was secure, they said.
The situation of foreign professionals working in the United States while awaiting green cards was sidelined in this year's contentious immigration debate, which focused on illegal immigrants, Bajaj said by telephone from Wisconsin.

Your attorney HAS to reply to your inquiries. It is stated in every State's BAR website. Otherwise, you have right to make a complaint that stays with the BAR records forever. BAR has to publish it to anyone who asks for information about that attorney. Attorneys do not want that.
We were in a similar situation. We sent an e-mail and left a voicemail saying something like: "In our point of view, a reasonable time for you to reply to our inquiries is 3 business days. If you do not call us and let us know another reasonable period of time for a reply period immediately, we will assume that you will reply to our inquiries and/or let us know the information about our case coming from USCIS in three days".
I guess we are learning this country's ways.
