We heard so many stories about violation many Indian bodyshoppers like bench without pay,Low pay ,fake resumes and many more. But when any bill comes to control them we are opposing. Because we fear that we may be one of the persons working in those companies and may be impacted by that.
Certainly the bill is not a pro immigrant and anti immigrant bill. But some kind of restriction is needed to clean out H1b. I accept as a pro immigrant we have to oppose any anti immigrant bill. So I am sure IV will try to block the bill as they did the restriction in TARP.
I am not going to get any benefit if they shut the door behind me. I need just one job that I can get any time and whatever compettion and there is no need to shut thousands of people. So my views are not based on any personal ambition.

For example, you can get H1b extension based on your pending/approved PERM labor or your approved I-140 application. So, any change to H1b will in some way impact the GC process. I'm all for closing the loop holes in H1b provided certain reforms are also made in the EB green card process- like removing per country quotas and may be give EAD upon I-140 approval.

Opened a SR on 7th Sept and wrote a request to local Congress man.
Approval: 10th Sept
Got a email approval for spouse on 10th Sept ! No changes seen in my status online but I got a response for my SR request that my case is also approved on 10th Sept, the email from SR came on 10th Sept.
Till date no changes to my status online but when you call the USCIS toll free number, I do here my case is approved on 10th Sept.
Just sharing my experience and thanks to Immigration voice forum.

I got the RFE at last. I invoked AC21. The RFE for me is asking for 2 evidences
01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that
02. Submit current dated EVL for your new employer. No issue. we can answer that
For my wife also asking for 2 evidences:
01. About the same medical issue.
02. Provide her non-immigrant status between Feb 2003 to Jan 2004.
I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.
I personally know a friend of mine who did the same mistake. He was not aware that he will also have to file for his wife when he did an h1 ext few years back. Lawyer was also not aware that he was married at that time. His 485 is still pending in EB-3, so no idea what would be the outcome.

I agree with both of your points: a solid action plan from IV core team would go a long ways to inspire and motivate others and that we should continue spreading the word (by writing to change.gov, news organizations, law makers etc.). Comments from IV core team are welcome.

I have a feeling that the IO might look at the applications received on Aug 17, 2007, only at last. Its because, when I went for infopass, the IO said that, "You have filed on the last date, so you will have to wait".

While I agree in principle to what is being suggested here (I voted for this on Change.gov), I think it may be easier to win this battle with a smaller change:
The five year clock for obtaining US Citizenship (post Permanent Residency) must start at the time Adjustment of Status (I-485) has been filed.
For example: If you are approved for Permanent Residency after a long 5 year wait of filing your I-485, you should be eligible to apply for citizenship immediately without a further wait.
This takes away at least part of the suffering caused for the legal immigrant community. The effect of USCIS processing delays and visa retrogression can be mitigated at least when it comes to obtaining citizenship.

If you can call it EB2 line, yes he will come before you. On the other hand an EB3 guy calls it �GC� line and says that you come later with a Masters and go before him in the line. It depends on which way you look at it.

Yes, I do agree that we should have some sense of personal responsibility and that is why the middle way is to rent out the house (probably at a bit lower price than your monthly mortgage) and pay the difference from your pocket - if you have to absolutely move out from the house. But, can somebody answer my question above..........why is the same house (not even a brick changed) being appraised at around 100k lower than it was done 2 years back, by the same bank??

Your posts are enlightening and breath of fresh air in an otherwise non-nonsensical forum discussion. Although people would want to, but talk about ethics and moral is not forbidden, not yet at least.
The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.

Punjabi77, good luck to you buddy. This will pass too, don't ruin everything for $20K. You will earn it back but you can't undo foreclosure and whatever comes with it in terms of personal memory, your credit and things in future that you can't foresee now. Do the right thing it will only make you stronger and someday you will be able to tell your kid that you did the right thing in the face of adversity and eventually not only survived it but thrived out of it.

Your posts are enlightening and breath of fresh air in an otherwise non-nonsensical forum discussion. Although people would want to, but talk about ethics and moral is not forbidden, not yet at least.
The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.
In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. Hi Folks,
In many of the articles and forums I have read that applicants spent a lot of money on medical exams, lawyer fees, and so on towards the Employee based Green Card application.
Is it legal for one to spend money (out of one's own pocket) towards getting employee based green card ?
From what I had hear from my company's legal department was that they cannot take any money from me towards the green card application as it is not legal. Employee Based Green Card is for Employer's benefit and not employee's....though it eventually helps the employee -:)
Any comments ?

Now since the dates have become current we would like to add our child who was born in India and currently living with us here ( we are still maintaining H1 and H4 status valid). I wanted to find out what documents and letter( to build the case) is required for adding our child to the application. Also would like to find out if we need to attach our child to existing application(mother or father) or file is seperately. Anybody please advise

We should form a union and flout our numbers to lobby aganist any bill. Unless we show our numbers nobody is going give flying f*** about us.
So UNION is good when you want to be on that for collective bargaining to serve your ends.
However, it is really bad for the economy when auto-workers have a union (as many mentioned in this forum about the non-existent $94/hr UAW worker).
BTW, this is not the only place where Indian IT professionals are expressing the need for UNION. These days, I saw even offshore company employees talking about the need for UNION since many companies like Infosys are quietly sacking employees without any severence.
