Dear All,
We need to expose the fraudulent EB1 filing by Indian companies! Under the circumstances, I think that this issue is much more relevant now! As such, I would once again like to share the information which I obtained about 6 weeks back from the local Congressman's office.
I was pleasantly suprised to learn that many Indians have been quietly writing about the fraudulent EB1 filing by Indian IT companies to lawmakers! I was told that the local office had received about 50 or so signed (hard copy) letters and that they had subsequently spoken to the INS office about this. It is a good thing that some conscientous Indians are quietly working behind the scenes for the welfare of the community.
Subsequently, I also made a letter on the subject and hand delivered the same the very next day, to the Congressman's office. I then also posted my letter to the Senators of my state.
I once again plead with all fellow EB Indian friends to write letters (please do not Email) about the fraudulent EB1 filings by Indian IT companies (TCS, CTS, L&T-IT, Infosys, Vetri software, et al) to your local congressman / senators. Please also visit your lawmakers to follow up. Personally, I feel that this very very important. IV is there to help us, but all of us must also play a role to get results
It is the strategy that will win the war, not always brute force! We should adopt a multi-pronged attach strategy, realising that each ever visa no. we get is important!
Spending about an hour of your time to write, print, sign and post could save many atleast 2 years of wait time. Did your realize this?
Imagine the impact of 1000s of covers getting dumped in your law makers' offices!
Even lawmaker's offices feel that the impact of printed and signed hard copies is much higher that Emails!
If we are united and focused, we can all win!

I signed for the Vonage initially was their customer for about a month on world phone. However, Lingo's attractive feature of calling form my mobile to any phone in India lured me to switch over to Lingo. i requested for phone no portability and am expecting the device shortly. I remember initially on this forum it is being mentioned that Calling from a mobile attached to a lingo phone was free only to call landline numbers in India. Couple of days back when I enquired I was told that it is no more restricted to landline but is to landline and mobile phones in India.
Just want to reconfirm with members in the community if some one has concrete information about this feature. Once again the feature am talking about is Calling from your mobile through Lingo to any mobile or landline number.
May be those who are already lingo customers can chip in their thoughts.

You may google to find out the senator(s) for your state. Every senator must be having their own web-site. Get the phone # from their web site. Call them and tell them that you need help in Immigration and explaing them briefly. They will take your SRC # and contact TSC on behalf of you.

Lawyer is sharing info that some of their client have got fee invoice from NVC. I have done family based application through NVC for my parents and I know you get fees invoice almost 4 months prior to your GC interview date. So lawyer is thinking that NVC is thinking to go upto Nov 2007 in case if CIS fails to act on enough cases in last months.

I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me.
You should just fill a dispute form and send it to your credit card issuer. It's probably not too late. The bank can and should refund you the overpay.

you guys might want to talk to your attorneys. Most of the time attorneys ping with their contact in service centers and get some answers if it is still not receipted.
Most of them have an email id whom they contact and find out normally. I am not sure if service centers are responsive if there are huge amounts of data entry still going on.

You are trying to say I can sign an application then mail it with just fee. You think they will accept without any Initial Evidence. I know about them relaxing condition on Medical. When did they relax it for all other Initial Evidence as well.
Not this time. USCIS clearly mentioned that Completed application with Signatures, Correct Fees should be sufficient. They are even accepting without medicals.

Lingo has a world plan which included unlimited calling to 30 countries( India not included)
India calls were just 2 cents per minute. I switched to Lingo from Vonage 2 months back. Sensing this mass exodus, vonage came up with an even more aggressive plan.

I would request stop replying on this thread and let it archive. If someone has to report the fraud he would have done it long time back.. this thread is just to provoke others and thats it.
I am not in support of any fraud but also not in support of provoking anyone for no reason.
There is a well documented process in each organization and in government on how to report the violation. If someone has any issue please follow the guidelines and do the needful.
Read between the lines and you have just confirmed my translation.

He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.

The way I look at your story is that you want to get back at your company in some way. You were employed as L1 by your company all this while and you did not care about fraud at that time ? You were enjoying the benefits so you did not care. Now since your company is going to send you back to India anyways, you want to do everything possible to get them in trouble.
I dont support fraud in any way and I do think such companies should be punished. But you dont have my sympathy either since you think fraud is ok as long as you are benefitting from it.

I am speaking from experience. Download the forms needed for filing 485, EAD and AP. Then when your attorney send you his/her set ( normally they do this in 2 stages - one they will send you a draft copy to verify and correct all info - some have online questionnaire; stage two - they send the final forms for you to verify and sign again - this they may do paper copy or online PDF - that cannot be edited - not fill able forms).
So, here I am providing links to all forms that I know are needed. These from uscis.gov site are fill able. Weekend is coming. Fill them, and print and keep them.
When attorney sends papers, compare yours with their and do corrections in theirs ( usually it will have stamps of the firm)
Application To Register Permanent Residence or Adjust Status - I-485
Medical Examination of Aliens Seeking Adjustment of Status - I-693
There is a supplemental 693 also for vaccination records.
Biographic Information - I-325 A
There are A, B, C and other versions. I filled A
Application for Employment Authorization - I-765
Application for Travel Document - I-131
Affidavit of Support - I-134
I completed all these forms with 100% correct info- still the Paralegal - made mistakes again and again ( I can't correct the PDF as Adobe PDF writer is 1800 USD). I lost ONE precious week. Hoping to file on 06/01/2007, filed on 06/08. Learn and be wiser from experience, yours and others.
